PUBLIC CONSTRUCTION LAW

Public construction law governs the legal relationship between property or infrastructure developers, on the one side, and government agencies on the other side.

Apart from our specialised legal advice, we represent clients before all Swiss courts and public agencies. This includes oppositions or appeals against building permits or the defence against such oppositions or appeals. Our clients in the field of public construction law include building owners, neighbours affected by some developments as well as public authorities.

Fields of public construction law

  • Building law (building permits)
  • Spatial planning law
  • Law on the protection of monuments
  • Environmental law (e.g. noise from restaurants or airports, contaminated sites, car parks, environmental impact assessments)
  • Lex Koller (acquisition of land by foreign nationals)
  • Lex Weber (restriction on the construction of secondary homes)

PRIVATE CONSTRUCTION LAW AND REAL ESTATE LAW

Private construction law governs the legal relationship between private individuals or entities. The focus is particularly on issues regarding the construction of a building, the acquisition and sale of real estate. Private construction law is often closely related to the rules of SIA, such as the general terms and conditions for construction work (SIA 118) or the regulations governing services and fees of architects or engineers (SIA 102/103).

Our services include drafting, reviewing and negotiating agreements, advice relating to work defects, liability and other construction law issues as well as representation in court proceedings or arbitration. We advise and represent building or infrastructure owners, building contractors, architects, engineers and other planners as well as private or institutional buyers and sellers of real estate.

Fields of private construction law

  • Law of mandate
  • Law concerning contracts for work and service (e.g. issues relating to warranty claims)
  • Property law (e.g. easements such as the right to build closer to the boundary, right of way for footpaths and driveways, construction law)
  • Condominiums
  • Statutory mortgage right of building contractors
  • Neighbour law (noise, smell, etc.)
  • Plants
  • Real estate acquisition
